These terms govern the operation of the online store, user rights, and the business relationship between the store owner and the consumer. REGISTRATION
By registering on our online store, you receive a username (your email address) and a password, which you create yourself. These uniquely identify and link you to your data. By registering, you confirm that you are of legal age and fully capable of entering into a contract. Upon registration, you become a user with the right to make purchases, and upon purchasing, you become a customer.
PURCHASE
After placing an order, you will receive a notification by email or phone confirming that your order has been accepted. Within 2 hours of receiving this notification, you may cancel the order or correct any errors, which we will gladly accommodate.
If you later notice an error or wish to cancel the order, please follow the procedure under “Product Returns” and send a cancellation notice to info@heka-supplements.com. You may also use this procedure if you have not yet received the products. If the products have not yet been handed over to the delivery service, you will not incur any return costs.
After 2 hours of order acceptance and up to a maximum of 72 hours (working days), the order will proceed for further processing. We review the order, check the availability of ordered products, and either confirm or reject it with a reason. In case of any ambiguity, we will contact you at the phone number provided during the purchase process. Upon order confirmation, we will also inform you of the expected delivery date.
If you did not receive an order confirmation, there might have been a technical error or incorrect data entry. In any case, please contact us for assistance.
SALES AGREEMENT
By confirming your order, a sales agreement is formed between the provider and the buyer. A printed invoice will be issued, itemizing the costs and explaining your right to withdraw from the purchase by returning the purchased product. The sales contract, in the form of a purchase order in electronic format, is stored on our server and is accessible at any time in your user profile. The sales contract is concluded in the Slovenian language.
PRICES
All prices in the online store https://old.heka-supplements.com/ are listed in EUR and include the prescribed VAT. Prices are valid only for online orders placed through the store.
While we strive to ensure the accuracy of data, occasionally product availability, characteristics, or prices may change too quickly for us to update in real-time. If this occurs or if the product price changes during order processing, we will notify you, allowing you to cancel the purchase and offering a mutually satisfactory solution.
PAYMENT METHODS Credit/Debit Card Payment
You may complete the payment in the online store at the checkout. Based on your choice, you will be guided through a secure system where you can enter your data and card information. The purchase amount will be initially reserved and finally charged once we send you an order confirmation email.
Prepayment
The order value can be paid by postal or bank transfer using a BN-02 or UPN form in online banking. Please pay only after receiving our email confirmation of your order, as we cannot guarantee timely delivery before then. You may notify us of your payment at our email address, or we will confirm receipt of payment by sending a shipment notice. If payment is not received within 72 hours of order confirmation, your order will be canceled.
Cash on Delivery
The order value can be paid in cash or by card on delivery. Other shipping costs were already paid at the time of ordering.
DELIVERY
Our contracted delivery partners are Pošta Slovenij or GLS. Upon dispatch, you will be notified by SMS, and the courier will call you on the delivery day to personally deliver the package. The delivery cost is a flat rate of €2.90 for other European countries at €4.90 for orders up to €80; above this amount, delivery is free. Inspect the products visually and numerically upon receipt and note any visible damage on the packaging or goods. Always sign the receipt document when receiving the package.
DELIVERY TIME
Since most items are available from stock, you will receive most products within 3-10 days after order confirmation. Delivery may take longer for items sourced from abroad or intermediaries, which we will inform you about upon order confirmation via email.
If you believe your order is delayed, notify us at info@heka-supplements.com, and we will make every effort to expedite your order. For urgent deliveries, we recommend placing your order well in advance and noting “urgent delivery” in the comments so we can promptly address any issues that may arise.
MATERIAL DEFECTS
A consumer can assert their rights due to a material defect if they notify the seller within two months of discovering the defect. The consumer must describe the defect precisely and allow the seller to inspect the product.
The seller is not liable for material defects that appear after two years from the date of delivery. If the defect appears within six months of delivery, it is presumed to have existed at the time of delivery.
A consumer who notifies the seller correctly about a defect has the right to demand that the seller either rectifies the defect, refunds part of the payment proportional to the defect, replaces the defective product with a new one, or refunds the full payment.
WHEN IS A DEFECT MATERIAL? A defect is considered material when:
- The product lacks properties required for normal use or sale.
- It lacks properties necessary for a specific purpose known to the seller.
- The product does not have qualities or characteristics that were expressly or tacitly agreed upon.
- The seller delivered a product that does not match the sample or model unless the sample or model was shown only for informational purposes.
RIGHT OF WITHDRAWAL AND RETURNS
If you are unsatisfied with a product, you may return it, provided it is in its original packaging, unused, undamaged, and in unchanged quantity. You also have the right to return items that are defective, spoiled, lost, or reduced in quantity through no fault of your own. You do not need to provide a reason for the return, although feedback is appreciated to help us improve.
To return a product, notify us within 14 days of receiving it by emailing info@heka-supplements.com with a clear statement that you wish to withdraw from the sales agreement. Return the products promptly, and at the latest within 14 days of giving notice of withdrawal, in their original, unused condition. Send the product by post to: GlobalPharmacia Group d.o.o., Poklukarjeva ulica 27, 1000 Ljubljana or return it to our business location in person.
The consumer covers only the return shipping costs when withdrawing from the contract. For all returned products received within the specified period and returned justifiably (see the first paragraph), we will refund all payments made within 14 days after receiving the notice of withdrawal from the contract, or at the latest, upon receipt of the returned goods, or when proof is provided that the goods have been sent back.
If products are returned without their original packaging, or if the packaging is damaged, or if the product shows signs of use, we reserve the right to refuse a refund. This means we will not return the payments made, but you may still return the products. Return shipping costs are at your own expense. To avoid complications, please do not open the products after receipt until you are certain they meet your expectations.
Companies, sole proprietors, and other legal entities do not have the right to withdraw from the contract within 14 days after receiving the product without reason, as this right applies only to consumers (individuals).
COMPLAINTS,DISPUTES, AND APPLICATION OF LAW
In case of a complaint or claim, please write to us at info@heka-supplements.com. We will confirm receipt of your complaint within 5 days and inform you about the expected timeframe and the method for handling it. In doing so, we will follow applicable consumer protection legislation. We will keep you informed of the progress of your complaint throughout the process. We will make every effort to resolve potential disputes amicably; otherwise, the competent court in Ljubljana will have jurisdiction, and Slovenian law will apply.
We recognize that a key characteristic of consumer disputes is the disproportion between the economic value of the claim and the time and costs involved in resolving the dispute, which is also the main reason why consumers often do not pursue disputes in court. Therefore, our team strives to resolve potential disputes amicably to the best of our ability.
Out-of-Court Settlement of Consumer Disputes
According to legal regulations, we do not recognize any provider of out-of-court dispute resolution as competent for resolving consumer disputes that a consumer could initiate under the Act on Out-of-Court Settlement of Consumer Disputes. GlobalPharmacia Group d.o.o., as a provider of goods and services through its online store in Slovenia, publishes on its website an electronic link to the Online Dispute Resolution (ODR) platform. This platform is available to consumers at the link HERE.
This arrangement is based on the Act on Out-of-Court Settlement of Consumer Disputes, EU Regulation No. 524/2013 of the European Parliament and of the Council on online dispute resolution for consumer disputes, and the amendment to Regulation (EC) No. 2016/2004 and Directive 2009/22/EC.
Limitation of Liability
Although we make every effort to ensure the timeliness and accuracy of the information published on our website, product characteristics, availability, and prices may change so quickly that we may not be able to update all information in time. In such cases, we will notify you of changes and allow you to cancel or replace the ordered product.
GlobalPharmacia Group d.o.o. reserves the right to withdraw from the contract only if an obvious error is discovered (Article 46 of the Code of Obligations). An obvious error is defined as a defect in essential characteristics of the product and all errors that are deemed decisive according to trade practices or the purpose of the parties, and which GlobalPharmacia Group d.o.o. would not have approved or concluded the contract in the event of awareness. This also includes obvious price errors.
While we strive to provide accurate product photos, all photos are symbolic and do not guarantee the product’s characteristics. We do not accept responsibility for typographical errors.
